§ 1 Scope
These Terms and Conditions apply to all contracts between

and its customers for the paid or free provision of PrestaShop modules, templates, support and other agency services.
§ 2 Subject Matter
- silbersaiten operates the domain silbersaiten.de, offering digital content (software, templates, documentation) and related services.
- The exact scope of services results from the respective product description in the shop or an individual offer.
§ 3 Customer Obligations
- Provide truthful and complete information during registration.
- Keep login data confidential.
- Maintain data backups in accordance with the state of the art.
§ 4 Right of Withdrawal
Consumers have a statutory right of withdrawal. For purely digital content, the right lapses once we start the download after the consumer has explicitly consented and acknowledged the loss of the right (Art. 16 lit. m Directive 2011/83/EU, Art. 103 m) Royal Legislative Decree 1/2007).
§ 5 Prices and Payment
- All prices are net plus the Canary Islands General Indirect Tax (IGIC) or the VAT applicable in the destination country.
- Permitted payment methods are shown during checkout.
- Invoices are sent electronically by e-mail only.
§ 6 Copyright and Licence
The supplied software products are protected by copyright. The customer receives a non-exclusive, non-transferable licence for one live shop per purchased licence. Copying, distribution or public reproduction outside this scope is prohibited.
§ 7 Warranty and Liability
- We are liable for defects under Spanish civil and commercial law; mandatory consumer rights in the EU remain unaffected.
- For slight negligence, liability is limited to essential contractual obligations (cardinal duties) and to the foreseeable, typical damage.
§ 8 Data Protection
Personal data are processed in accordance with the Privacy Policy below, the GDPR (EU 2016/679) and Spanish Law 3/2018 (LOPDGDD).
§ 9 Applicable Law and Jurisdiction
- Spanish law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- For merchants and public-law entities, exclusive venue is Arrecife (Spain).
- For consumers, mandatory protective laws of their residence state remain applicable.
§ 10 Severability
If any clause of these T&C is or becomes invalid, the validity of the remaining clauses shall not be affected.
